Welcome to Forecast. Forecast is a brand of FK Logistics LLC ("Forecast," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, products, and services (collectively, the "Services").

By accessing our website or purchasing our products, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to purchase our products or use the Services. By using the Services, you represent that you are 18 or older and legally able to enter into a binding contract.

2. Important Health & Product Disclaimers

Please read this section carefully.

Forecast products are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.
Nothing on our website, packaging, marketing materials, or communications constitutes medical advice. Content is provided for informational purposes only.
Consult your physician or a qualified healthcare provider before using any Forecast product, especially if you are pregnant, nursing, taking medication, or have a medical condition.
Individual results vary. Testimonials and reviews reflect individual experiences and are not a guarantee of results. Products should be used in conjunction with a balanced diet and healthy lifestyle.
Do not exceed the recommended serving. Keep out of reach of children.
You are responsible for reading product labels, including ingredient lists and warnings, before use. If you experience an adverse reaction, discontinue use immediately and consult a healthcare professional.

3. Orders, Pricing, and Payment

All prices are listed in U.S. dollars and are subject to change without notice.
We reserve the right to refuse, limit, or cancel any order at our sole discretion, including orders that appear to be placed by resellers or that we suspect are fraudulent. If we cancel an order after payment, we will issue a full refund.
You agree to provide accurate, current, and complete purchase and account information. You are responsible for any applicable taxes.
Promotional pricing, discounts, and bundle offers may be modified or withdrawn at any time. Discounts cannot be combined unless expressly stated.
In the event of a pricing or typographical error, we reserve the right to cancel affected orders and refund any amounts paid.

4. Shipping and Delivery

Estimated shipping times are provided as a courtesy and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or other events outside our control.
Risk of loss passes to you upon our delivery of the products to the carrier.
You are responsible for providing an accurate shipping address. We are not responsible for orders shipped to an incorrectly entered address, and such orders are not eligible for refund or replacement.
If a package is confirmed lost in transit by the carrier, contact us and we will work with you to resolve the issue.

5. Refund and Return Policy — ALL SALES FINAL

Because our products are ingestible consumables, all sales are final. For health, safety, and quality-control reasons, we cannot accept returns or restock products once they have left our facility, whether opened or unopened.

We do not offer refunds, returns, or exchanges except as follows:

Defective, Damaged, or Incorrect Products

If your product arrives defective, damaged in transit, or you receive the wrong item, we will make it right with a replacement or refund, at our option. To be eligible:

Contact us at support@forecastwellness.com within 14 days of delivery.
Include your order number and clear photos of the product and packaging showing the defect, damage, or incorrect item.
Do not discard the product or packaging until your claim is resolved — we may request its return to our facilities for internal inspection, or additional documentation.

Approved refunds are issued to the original payment method. Please allow 5–10 business days for the refund to appear, depending on your bank.

What Is Not Covered

Change of mind, dissatisfaction with taste or flavor, or failure to achieve desired results (individual results vary — see Section 2)
Orders shipped to an address entered incorrectly at checkout
Products purchased from unauthorized third-party sellers
Products damaged after delivery due to improper storage or handling

By completing a purchase, you acknowledge and accept this policy.

6. Chargebacks

If you believe there is an error with your order or charge, contact us first at support@forecastwellness.com so we can resolve it. Initiating a chargeback for a valid, delivered order in circumvention of this refund policy may result in suspension of your ability to purchase from us in the future, and we reserve the right to dispute illegitimate chargebacks and recover associated costs.

7. SMS and Email Communications

By opting in to our email or SMS lists, you consent to receive recurring marketing and transactional messages as described in our Privacy Policy. Consent to marketing messages is not a condition of purchase. You may unsubscribe from emails via the link in any message and opt out of SMS by replying STOP.

8. Intellectual Property

All content on the Services — including the Forecast name, logos, product names, packaging designs, photographs, videos, text, and graphics — is owned by or licensed to us and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.

9. User Content

If you submit reviews, photos, testimonials, or other content to us or tag us on social media, you grant Forecast a perpetual, worldwide, royalty-free, transferable license to use, reproduce, modify, display, and distribute that content in connection with our business, including in advertising. You represent that you own the content you submit and that it does not violate any third party's rights.

We may remove any user content at our discretion, including content that is false, misleading, or makes health claims inconsistent with Section 2.

10. Prohibited Uses

You agree not to:

Use the Services for any unlawful purpose
Purchase products for resale without our written authorization
Scrape, copy, or harvest content or data from the Services
Interfere with the security or operation of the website
Impersonate another person or misrepresent your affiliation with anyone
Make false or misleading claims about our products

11. Disclaimer of Warranties

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCTS WILL MEET YOUR EXPECTATIONS OR PRODUCE ANY PARTICULAR RESULT.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FORECAST AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Forecast and its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the products, or your violation of any law or third-party right.

14. Dispute Resolution; Binding Arbitration; Class Action Waiver

Please read this section carefully — it affects your legal rights.

Informal resolution first: Before filing any claim, you agree to contact us at support@forecastwellness.com and attempt in good faith to resolve the dispute informally for at least 30 days.
Binding arbitration: Any dispute arising out of or relating to these Terms, the Services, or the products that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
Class action waiver: YOU AND FORECAST AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE PROCEEDING.
Exceptions: Either party may bring an individual claim in small claims court, and either party may seek injunctive relief for intellectual property infringement.
Opt-out: You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase with your name, order number, and a statement that you opt out of arbitration.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable U.S. federal law, without regard to conflict-of-law principles. Where arbitration does not apply, you consent to the exclusive jurisdiction of the courts located in Puerto Rico.

16. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" above reflects the latest revision. Changes take effect when posted. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

17. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
Our failure to enforce any provision is not a waiver of our right to do so later.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forecast regarding the Services.
You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
